Have you been arrested and charged with driving under the influence (DUI) of alcohol or drugs after failing a breath or blood test or after being stopped at a DUI checkpoint? Our Salt Lake City DUI lawyers have substantial experience building DUI defenses and we have successfully represented numerous clients throughout Utah who were charged with drunk driving.

At True West Legal, we believe that it is important to be highly educated so that we can build the best possible defenses for our clients.

There are two different types of DUI offenses in Utah:

  • DUI - You will be charged with DUI if you are found to be operating a moving vehicle with a breath alcohol concentration equal to or in excess of 0.08 grams or if you are rendered incapable of safely driving due to drug or alcohol usage. Drunk driving is prohibited in Utah Code Annotated § 41-6a-502.
  • DUI Metabolite - The other type of DUI impacts people who are not capable of physically controlling their vehicles due to any measurable content of a controlled substance or metabolite of a controlled substance. Driving under the influence of drugs, including medication that hinders a person's ability to function, is prohibited in Utah Code Annotated § 41-6a-517.

Challenging Drunk Driving Charges

Penalties for a DUI conviction in the state of Utah can be very serious. For just a first offense, you could face 180 days in jail and $1850 in fines, in addition to miscellaneous penalties such as mandatory substance abuse treatment, installation of an ignition interlock device, up to 18 months of probation, community service hours, and more. These consequences increase with second and subsequent DUI convictions. In addition, you could lose your driver's license.

When you contact a Salt Lake City DUI lawyer from True West Legal, we will file your request for your DMV hearing free of charge - even if you do not ultimately choose to retain us for your DUI case. Remember, you have only 10 days from the date of your arrest to request a DMV hearing and attempt to save your driver's license. Do not miss this important deadline!
