TYPES OF DUI IN UTAH

There are two different types of DUI offenses in Utah:

  • DUI - You will be charged with DUI if you are found to be operating a moving vehicle with a breath alcohol concentration equal to or in excess of 0.08 grams or if you are rendered incapable of safely driving due to drug or alcohol usage. Drunk driving is prohibited in Utah Code Annotated § 41-6a-502.
  • DUI Metabolite - The other type of DUI impacts people who are not capable of physically controlling their vehicles due to any measurable content of a controlled substance or metabolite of a controlled substance. Driving under the influence of drugs, including medication that hinders a person's ability to function, is prohibited in Utah Code Annotated § 41-6a-517.
