In Utah, felonies - or crimes punishable by time in state prison - are classified as either capital felonies, first-degree felonies, second-degree felonies, or third-degree felonies. This is outlined in Utah Code Annotated § 76-3-103. The penalties for the various felony categories are as follows:
- Capital felonies - Reserved for the most serious crimes, such as homicide; the punishment for a capital felony is either life in prison or the death penalty (Utah Code Annotated § 76-3-206)
- Felonies of the first degree - Between 5 years to life in prison, up to $10,000 in fines plus surcharges (Utah Code Annotated §§ 76-3-203, 76-3-301)
- Felonies of the second degree - Between 1 and 15 years in prison, up to $10,000 in fines plus surcharges (Utah Code Annotated §§ 76-3-203, 76-3-301)
- Felonies of the third degree - Between less than 1 year and 5 years in prison, up to $5,000 in fines plus surcharges (Utah Code Annotated §§ 76-3-203, 76-3-301)
